DFW New Construction Buyer FAQ
What should I know before buying new construction in Dallas-Fort Worth?
Four things change the transaction. The contract is the builder's own document rather than the TREC promulgated form. The person in the sales office works for the builder. Whether your agent is recognised depends on a registration policy that usually turns on when they first appeared. And district assessments attach to the platted lot, so the city on the sign does not reliably tell you which city, county or school district applies.

Do I need my own agent to buy new construction?
No law requires it. The builder's representative works for the builder, so without separate representation nobody at the table is working for you. Whether that matters depends on how much of the process you want to handle alone.
Does it cost me anything to be represented?
In most DFW new construction transactions the builder pays the buyer agent's compensation, so representation generally costs the buyer nothing directly. The arrangement is set by each builder and should be confirmed for the community.
What is builder registration and why does the timing matter?
Most production builders operate a policy governing whether a buyer's agent is recognised. It commonly turns on when the agent first appeared rather than on what the buyer intended, and it is generally not reversible on that community. Should I visit model homes on my own first?
You can, and many buyers do. Understand that in most communities the registration question is answered by that visit.
Choosing a community
Is the community actually in the city it is named after?

What is a MUD or a PID and does it matter?
Both fund infrastructure, but they are jurisdictionally different: a MUD generally exists outside city limits, a residential PID inside them. Neither is a reason to avoid a community, and communities carrying them are frequently priced accordingly. See the MUD, PID and HOA reference.
Does build-out stage matter?
Yes, more than most buyers expect. It determines what exists today versus what is on the site plan, how long construction traffic continues, and which amenities are funded rather than promised.
How do I compare two builders in the same community?

Contract and selections
Do builders use the standard TREC contract?

Is my earnest money refundable?
It depends on the structure and the stage. Builder contracts commonly define points beyond which some or all of a deposit stops being refundable, and layered deposits can have different points for different layers.
Is the price negotiable?
What moves and what does not varies by builder, by community and by where a section sits in its build-out. The accurate answer is specific rather than general, which is exactly why it is worth a conversation.
Do I have to use the builder's lender?
Not usually, but advertised incentives are frequently conditioned on it. The real question is what changes if you do not, and that is a contract term.
When do my selections lock?
Structural selections generally close well before finish selections. The schedule is set by the builder and stated in the selections addendum.
What happens if I want to change something after signing?
That is a change order, and whether it is permitted, what it costs administratively and whether it affects the schedule all vary by builder.
Build, inspection and closing
Do I need an inspection on a brand new home?
Many buyers arrange independent inspections at defined stages. A builder's own quality control review and a municipal inspection serve different purposes from an independent inspection engaged by the buyer.
What happens if the builder misses the completion date?

How long does a build take?
It varies by builder, plan, community and stage of the market. Treat any figure quoted early as a planning assumption rather than a commitment, and read what the contract says about the date.
What does the builder warranty actually cover?
Express warranties are commonly tiered, with a short workmanship period, a longer systems period and a long structural period. How you make a claim, what notice is required and whether coverage transfers on resale are set by the warranty document rather than by general practice.
Buying from out of state
Can I buy new construction in DFW without visiting?

Does my relocation package affect who can represent me?
Sometimes. Where an employer engages a relocation management company, the package may condition benefits on using an approved network. Confirm with your relocation counselor before engaging anyone.
Should I rent first?
It depends on the certainty of the role, the departure home sale and how well defined the commute is. Neither answer is general.
