When an older client needs to sell the family home, downsize, or buy into an active adult community, the real estate transaction usually lands in the middle of work you are already doing: a financial plan, a trust, a Medicaid application, a care placement, an estate. No referral fees, and why that matters

Texas law limits who may be paid for a real estate referral: compensation for referring real estate business can be paid to a licensed real estate agent or broker, not to an unlicensed professional. Nitin does not pay referral fees to financial advisors, attorneys, accountants, fiduciaries or care professionals, and will not offer one.

That is a feature of this arrangement rather than a limitation. Your client should hear the same recommendation from you whether or not money moves, and your own professional standards, whether fiduciary duty, bar rules or conflict-of-interest policy, are cleaner when there is no compensation to disclose. Referrals between licensed agents are handled separately and normally.

The situations that come up most

  • Downsizing while a client is still fully independent, where the goal is fewer stairs, less maintenance and freeing equity, and there is time to do it properly.

  • A move into independent or assisted living, where the sale timing has to line up with a community deposit or entry fee and the family is managing a lot at once.

  • A sale directed by a trust, a power of attorney or a guardianship, where the signer is not the occupant and the documentation has to be right before a listing goes live.

  • An estate or probate sale, where heirs may be in several states and the property has usually not been updated in years.

  • A sale connected to Medicaid planning or spend-down, where timing, proceeds and documentation matter and the legal strategy is yours, not Nitin's.

  • Aging in place, where the honest answer is that the client should not move at all, and the work is a realistic view of what the home is worth and what modifications would cost.

  • Buying into an active adult community, often new construction, where the builder contract, the HOA and any MUD or PID assessment change the monthly cost your plan assumed.

 

What Nitin does

Listing and selling the home, or representing the client as a buyer. A current, defensible valuation based on comparable sales rather than an automated estimate. An honest read on what is worth repairing before listing and what is not. Coordination with whoever else is involved, including you, the family, the care community and the closing attorney or title company. Contract, option period, inspections, appraisal and closing, handled so the timeline holds.

For a buying client, that includes the parts that break financial plans quietly: Texas property taxes calculated from the new appraised value rather than the seller's, HOA dues and what they cover, MUD or PID assessments in newer communities, and, for a client over 65, how the school tax ceiling and homestead exemptions work when moving within Texas. What Nitin does not do

He does not give legal, tax, Medicaid or investment advice, and will not step into your lane with your client. He does not run move management, estate sales or cleanouts in-house; those are referred to specialists who do that work full time. He does not push a sale on a client who should stay where they are, and if the analysis says aging in place is the better answer, that is what the client and the family will hear.

What you get back

  • A conversation before anything starts, so you know how the client will be handled and can tell them what to expect.

  • Updates at the pace you want them, with the client's permission, so you are not learning about a delay from your client.

  • Documentation your file needs: the valuation basis, the closing statement, and dates that matter for a plan, a filing or an application.

  • A pace set by the client. Nobody gets pressured, and a client who decides not to move is not pursued.

  • The client back. The relationship is yours. Nitin's job ends at closing.

Nitin holds the Seniors Real Estate Specialist designation from the National Association of REALTORS, along with CRS, GRI, ABR, PSA and MRP among 13 professional designations, and has closed 480+ DFW transactions. How to refer someone

Call 469-269-6541 or email nitin@nitinguptadfw.com with three things: what the client is trying to accomplish, the timeline you are working against, and who else is involved. If the client would rather make the first call themselves, send them the number and Nitin will take it from there.

Referral partner FAQs

Do you pay referral fees to advisors or attorneys?

No. Texas law limits payment for real estate referrals to licensed real estate agents and brokers, so no fee is paid to an unlicensed professional. That also keeps your own disclosure and conflict-of-interest position clean.

Who typically refers clients?

Financial advisors and wealth managers, elder law and estate planning attorneys, CPAs, professional fiduciaries and trustees, geriatric care managers, senior move managers, and staff at independent and assisted living communities.

Can you work with a sale directed by a trust, power of attorney or guardianship?

Yes. Those transactions require the authority documents to be in order before listing, and the title company will review them. Nitin coordinates with the attorney handling that side rather than advising on it.

Do you handle probate and estate sales?

Yes, working alongside the attorney and executor. Heirs are frequently out of state, and the property usually needs a realistic view of what to repair and what to sell as-is.

Do you provide move management, estate sales or cleanouts?

No. Those are referred to specialists who do that work full time, which produces a better result for the client than an agent attempting it in-house.

What if the client should not move?

Then that is the recommendation. Sometimes the right answer is aging in place, and a clear picture of the home's value and the cost of modifications is more useful to your client than a listing appointment.
