Toll Brothers Purchase Agreement in DFW: Read It Before You Sign
A builder purchase agreement is not the standard TREC resale contract. Builders write their own. Protections you know from a resale may not appear, and terms you have never seen may. Send me your Toll Brothers contract before you sign, and I will read it with you.

Is a builder contract the same as a resale contract?
No. A Texas resale uses a standard TREC form that many buyers have seen. A builder writes its own purchase agreement. Do not assume the protections you expect carry over.
What does a builder contract cover?
I will not interpret clauses on a web page. Here is what the document covers. Each topic carries real cost and real consequences.
Deposits and what happens to them.
Completion timing and what counts as completion.
Price adjustments after you sign.
Change orders and who pays for them.
Warranty terms and how claims work.
Financing terms and deadlines.
Affiliated service providers.
How disputes are handled.
Toll Brothers, Inc. states that it operates its own mortgage and title businesses. Contract terms around affiliated providers deserve a conversation before you agree to anything.
Who explains the contract to you?
The sales team can walk you through the document. Their role is to sell the home. I read it for you and I flag what deserves a Texas real estate attorney. See builder contracts in Texas and who represents you in a Texas model home.
When do you send me the contract?
Before you sign, and before you pay any deposit. A signed contract is hard to unwind. Read MUD, PID and HOA questions and my closing process guide alongside it.
Start with my Toll Brothers buyer's agent page if you have not yet chosen representation.

Do not. A signed builder contract is hard to unwind. Send it to me before you sign or pay a deposit.
Do I have to use the builder's lender or title company?
