Can VA buyers pay their real estate agent in Dallas, TX?

Yes. Since VA Circular 26-24-14 took effect on August 10, 2024, veterans and active-duty buyers using a VA loan can pay a reasonable and customary buyer's agent commission — reversing a long-standing prohibition. The fee cannot be financed into the VA loan (it is paid in cash at closing) and requires a written buyer-broker agreement. Sellers can still pay it, and when they do, it does not count toward the VA's 4% seller-concession cap.

Cash, not financed: A buyer-paid agent fee is paid in cash at closing and cannot be rolled into the VA loan (unlike the VA funding fee).

The seller can still pay it: And when the seller covers your buyer-agent commission, it does not count toward the VA's 4% seller-concession cap.

Written agreement required: A buyer-broker agreement must be signed before touring homes and included in the loan file, itemized on the Closing Disclosure.

It's a temporary rule: Circular 26-24-14 is a temporary variance; a permanent policy is expected, so confirm the current rule with your lender.
